Welcome to Estimio! These Terms of Service ("Terms") govern your use of the Estimio mobile application (the "App") operated by Estimio ("we," "our," or "us").

By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Description of Service

Estimio is an AI-powered estimation application designed for construction professionals, including contractors, handymen, and remodelers. The App allows users to:

• Create project estimates using AI technology
• Manage clients and project information
• Generate and send professional proposals
• Upload photos for AI-powered analysis

2. Account Registration

To use certain features of the App, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

3. Subscription and Pricing

Free Trial

New users receive a 14-day free trial with full access to all features. No payment information is required to start the trial.

Subscription Pricing

• United States: $19.99 USD per month
• Canada: $24.99 CAD per month

Subscriptions are billed monthly through Apple's App Store. Your subscription will automatically renew unless cancelled at least 24 hours before the end of the current billing period.

Refund Policy

If you are not satisfied with Estimio, you may request a refund by contacting us at info@estimio.ai. Please include the reason for your refund request. Refund requests are handled on a case-by-case basis and are subject to Apple's App Store refund policies.

4. AI-Generated Estimates Disclaimer

You acknowledge and agree that:

• AI-generated estimates are not guaranteed to be accurate or complete
• Estimates may not account for all project variables, local conditions, or unforeseen circumstances
• You are solely responsible for verifying and adjusting estimates before presenting them to clients
• Estimio is not liable for any financial losses, disputes, or damages arising from reliance on AI-generated estimates

We recommend always reviewing AI-generated content and applying your professional judgment before finalizing any estimates or proposals.

5. User Responsibilities

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to the App or its related systems
• Upload content that infringes on intellectual property rights
• Share your account credentials with others
• Use the App to transmit harmful or malicious content

6. Intellectual Property

The App and its original content, features, and functionality are owned by Estimio and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of the content you create using the App, including your estimates, client information, and uploaded photos.

7. Limitation of Liability

To the maximum extent permitted by law, Estimio shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Damages arising from reliance on AI-generated estimates
• Service interruptions or technical issues beyond our control

Our total liability for any claim arising from your use of the App shall not exceed the amount you paid to us in the 12 months preceding the claim.

8. Indemnification

You agree to indemnify and hold harmless Estimio, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App or violation of these Terms.

9. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice, for any reason, including breach of these Terms.

You may terminate your account at any time by cancelling your subscription and deleting the App. To request deletion of your data, please contact us.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting the updated Terms in the App or on our website. Your continued use of the App after changes become effective constitutes acceptance of the new Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts located in Ottawa, Ontario, Canada.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
